Independent Artist Submission Agreement

Thank you for your interest in submitting your music to FAS Radio Network, a division of Allen Studios Holdings, Inc. We are committed to supporting independent artists by providing opportunities for radio airplay and exposure.

Please read this Agreement carefully. By submitting music, artwork, promotional materials, or other content ("Submission") to FAS Radio Network, you agree to the following terms.

 

 

1. Eligibility

You represent and warrant that:

  • You are at least 18 years of age or have the permission of a parent or legal guardian.
  • You have the legal authority to submit the material.
  • You own all rights to the submitted music or have obtained all necessary permissions, licenses, and authorizations from the copyright owners.
  • Your submission does not infringe upon the rights of any third party.

 

 

2. Ownership

You retain full ownership of your music, recordings, lyrics, trademarks, copyrights, and other intellectual property.

Submitting your music to FAS Radio Network does not transfer ownership of your work.

 

 

3. License to FAS Radio Network

By submitting your music, you grant FAS Radio Network a non-exclusive, worldwide, royalty-free, revocable license to:

  • Review your submission for programming consideration.
  • Broadcast your music on FAS Radio Network.
  • Stream your music through our website, mobile applications, and authorized streaming platforms.
  • Include your music in station programming, specialty shows, countdowns, interviews, and promotional broadcasts.
  • Display your artist name, song title, album artwork, promotional photographs, biography, and related promotional materials in connection with your music.
  • Promote your music on our website, mobile app, social media channels, newsletters, podcasts, and marketing materials for the purpose of promoting your appearance or airplay on FAS Radio Network.

This license does not transfer ownership of your intellectual property.

 

 

4. Airplay Is Not Guaranteed

Submission of music does not guarantee:

  • Radio airplay.
  • Placement on playlists.
  • Interviews.
  • Artist features.
  • Promotions.
  • Reviews.
  • Editorial coverage.
  • Continued rotation.

Programming decisions are made solely at the discretion of FAS Radio Network.

 

 

5. Editorial Discretion

FAS Radio Network reserves the right to:

  • Accept or decline any submission.
  • Edit metadata for consistency.
  • Categorize music into programming formats.
  • Schedule or discontinue airplay at its discretion.
  • Remove music from rotation at any time.

 

 

6. Artist Representations

You certify that:

  • Your music is your original work or you have obtained all necessary rights.
  • Any samples, guest performances, beats, instrumentals, or copyrighted material have been properly licensed.
  • Your submission does not violate copyright, trademark, publicity, privacy, or other legal rights.
  • The information you provide is accurate and current.

 

 

7. Royalties

FAS Radio Network does not pay artists directly for radio airplay unless otherwise agreed in writing.

If your music is eligible for digital performance royalties, those royalties may be collected and distributed through the appropriate performing rights organizations, digital rights organizations, distributors, publishers, labels, or collection societies in accordance with their respective policies and agreements.

Artists are responsible for ensuring that their recordings and compositions are properly registered with the appropriate organizations to receive any royalties for which they may be eligible.

 

 

8. Independent Artist Status

Submission of your music does not create:

  • An employment relationship.
  • A partnership.
  • A joint venture.
  • A management agreement.
  • A recording contract.
  • An exclusive distribution agreement.
  • An agency relationship.

 

 

9. Promotional Materials

You authorize FAS Radio Network to use promotional materials you provide, including:

  • Artist photos
  • Album artwork
  • Logos
  • Biographies
  • Press releases
  • Social media links
  • Website links
  • Promotional videos
  • Electronic Press Kits (EPKs)

These materials will be used solely to promote you and your music in connection with FAS Radio Network.

 

 

10. Removal Requests

You may request that your music be removed from future programming by submitting a written request to music@fasradio.net.

Removal requests will apply to future broadcasts only and will not affect content that has already aired, been archived where legally permitted, or been included in previously published promotional materials.

 

 

11. Indemnification

You agree to defend, indemnify, and hold harmless FAS Radio Network, Allen Studios Holdings, Inc., its owners, officers, employees, contractors, volunteers, affiliates, sponsors, and partners from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of:

  • Your submission.
  • Alleged copyright infringement.
  • Trademark infringement.
  • Defamation.
  • Violation of privacy or publicity rights.
  • Breach of this Agreement.
  • Any other legal claim related to your submission.

 

 

12. Limitation of Liability

To the fullest extent permitted by law, FAS Radio Network shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the submission, review, broadcast, promotion, or non-use of submitted materials.

 

 

13. Privacy

Information submitted by artists will be handled in accordance with the FAS Radio Network Privacy Policy.

We do not sell personal information to third parties. However, artist names, biographies, promotional photographs, and other materials intended for public promotion may be displayed in connection with your music.

 

 

14. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.

Any legal action arising under this Agreement shall be brought in the appropriate state or federal court located in North Carolina.

 

 

15. Changes to This Agreement

FAS Radio Network reserves the right to modify this Agreement at any time. Updated versions will be posted on our website with a revised Effective Date.

Continued submission of music after changes become effective constitutes acceptance of the revised Agreement.

Acknowledgment

By submitting music or other materials to FAS Radio Network, you acknowledge that you have read, understood, and agree to be bound by this Independent Artist Submission Agreement.
